1. Introduction

These Terms and Conditions ("Terms") govern your use of ResQ ("Service"), an AI-powered customer support platform operated by ResQ AI ("we," "us," or "our"). By accessing or using ResQ, you agree to be bound by these Terms.

2. Definitions

  • "User," "you," or "your" refers to individuals or entities using the Service.
  • "Content" refers to documents, text, and other materials uploaded to the Service.
  • "Widget" refers to the embeddable customer support interface provided by ResQ.
  • "Knowledge Base" refers to the collection of documents and information you upload to train the AI.

3. Account Registration

3.1. You must create an account using Google OAuth or email registration to use the Service.

3.2. You are responsible for maintaining the confidentiality of your account credentials.

3.3. You must provide accurate and complete information when creating your account.

3.4. Email verification is required to access certain features of the Service.

3.5. Free plan users are limited to 50 messages per day across all chatbot conversations.

4. Service Description

4.1. ResQ is an AI-powered customer support platform that uses Google Gemini to provide automated responses based on your knowledge base.

4.2. We do not guarantee that the AI will always provide accurate or complete answers.

4.3. The Service is provided on an "as is" and "as available" basis without warranties of any kind.

4.4. Features include document management, AI-powered question answering, customizable responses, analytics, voice call capabilities (Pro plan), and team management features.

4.5. Voice call recordings and transcriptions are available on Pro plan and subject to additional terms regarding data retention and privacy.

5. User Content and Knowledge Base

5.1. You retain all rights to Content you upload to ResQ.

5.2. You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your Content solely to provide the Service.

5.3. You are solely responsible for the accuracy and legality of your Content.

5.4. We reserve the right to remove Content that violates these Terms.

5.5. Document upload limits vary by subscription plan: Free plan (5MB per file), Pro plan (10MB per file), Enterprise plan (15MB per file), Custom plan (up to 50MB per file).

5.6. Character limits for knowledge base content (documents + rich text combined): Free (50K characters), Pro (200K characters), Enterprise (500K characters), Custom (1M characters).

5.7. Number of chatbots allowed varies by plan: Free (1 chatbot), Pro (up to 3 chatbots), Enterprise (up to 5 chatbots), Custom (unlimited).

5.8. Rich text editor content is subject to the same character limits and terms as uploaded documents.

6. Website Widget

6.1. You may embed the ResQ Widget on your website using the provided integration code.

6.2. You must not modify the Widget or attempt to extract its underlying code.

6.3. We retain all rights to the Widget and its underlying technology.

6.4. Widget customization options include colors, messages, icons, and behavior settings.

7. Payment Terms

7.1. Subscription fees are charged in advance according to your selected plan (Free, Pro $49/month, Enterprise $99/month, or Custom).

7.2. All payments are processed securely through LemonSqueezy with industry-standard encryption and fraud protection.

7.3. Subscriptions automatically renew unless canceled before the renewal date through your customer portal.

7.4. No refunds will be issued for partial subscription periods, except as required by law.

7.5. Pro plan ($49/month) includes up to 3 chatbots, 10MB document uploads, 200K character limit, chat history, voice calls with basic transcription, and priority support.

7.6. Enterprise plan ($99/month) includes up to 5 chatbots, 15MB document uploads, 500K character limit, advanced analytics, sub-user management, enhanced voice features with advanced transcription, and premium support.

7.7. Custom plan pricing varies based on requirements and includes unlimited chatbots, up to 50MB document uploads, 1M character limit, and custom integrations.

7.8. Additional AI usage beyond included limits may incur overage charges at $0.20 per 1 million tokens for Pro and Enterprise plans.

7.9. You can manage your subscription, update payment methods, and access billing history through the secure customer portal.

Payment processing is handled securely by LemonSqueezy, ensuring your financial information is protected with industry-standard encryption.

8. Acceptable Use

You agree not to:

8.1. Use the Service for illegal purposes or to violate any laws.

8.2. Upload Content that infringes intellectual property rights.

8.3. Attempt to gain unauthorized access to the Service or bypass rate limiting.

8.4. Use the Service to transmit harmful code or conduct denial-of-service attacks.

8.5. Reverse engineer or decompile any part of the Service.

8.6. Use the Service in a way that could harm our infrastructure or other users.

9. Rate Limiting and Usage Restrictions

9.1. The Service implements comprehensive rate limiting to ensure fair usage, system stability, and security.

9.2. Rate limits include: 100 general API requests per 5 minutes, 25 AI questions per 10 minutes, and 30 widget requests per 15 minutes per IP address.

9.3. Additional rate limits apply to specific features including voice calls, document uploads, and team management actions.

9.4. Excessive usage, abuse, or attempts to circumvent rate limits may result in temporary or permanent suspension of access.

9.5. Rate limits may be adjusted based on your subscription plan and usage patterns.

10. Data and Privacy

10.1. We collect and process data as described in our Privacy Policy.

10.2. We use industry-standard security measures to protect your data.

10.3. Data is stored securely and backed up regularly.

10.4. We may use analytics and caching to improve service performance.

11. Termination

11.1. We may terminate or suspend your account for violations of these Terms.

11.2. You may terminate your account at any time by canceling your subscription through your dashboard.

11.3. Upon termination, your right to use the Service ceases immediately.

11.4. Data deletion procedures will follow applicable data protection regulations.

12. Limitation of Liability

12.1. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

12.2. Our total liability for any claims shall not exceed the amount paid by you for the Service in the previous 12 months.

12.3. We are not responsible for the accuracy of AI-generated responses or decisions made based on them.

13. Indemnification

You agree to indemnify and hold ResQ AI harmless from claims, damages, and expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms
